- Scope of application

- Article 1 1.
- Contracts for Accommodation and related agreements to be concluded between this Hotel and the Guest to be accommodated shall be subject to the provisions of these Terms and Conditions, and any matters not provided for in these Terms and Conditions shall be governed by laws and regulations (meaning laws and regulations or those based on laws and regulations; the same applies hereinafter) or generally accepted practices.
- 2.
- In the event that the Hotel has entered into a special contract with a Guest, to the extent that it does not violate laws and regulations and generally accepted practices, notwithstanding the provisions of the preceding paragraph, the special contract shall take precedence.
- Application for accommodation contract

- Article 2 1.
- A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:
- Guest name
- Accommodation date and estimated time of arrival
- Accommodation fees (in principle, based on the basic accommodation fees in Appendix 1)
- Other matters deemed necessary by the Hotel
- 2.
- If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph (2) of the preceding paragraph, the Hotel shall treat it as if he/she had applied for a new Accommodation Contract at the time such request was made.
- Establishment of accommodation contract, etc.

- Article 3 1.
- An accommodation contract shall be deemed to have been established when the Hotel accepts the application as stipulated in the preceding Article. However, this shall not apply when the Hotel proves that it has not accepted the application.
- 2.
- When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, limited to the basic accommodation charge for the period of stay (if it exceeds three days, then for three days), shall be paid by the date specified by the Hotel.
- 3.
- The application fee will first be applied to the accommodation fee to be paid by the guest in full, and in the event that a situation occurs to which the provisions of Article 6 and Article 1 apply, it will be applied in the order of penalty charges and compensation, and the remaining balance, if any, will be refunded at the time of payment of the accommodation fee as provided for in Article 8.
- 4.
- If the application fee in Paragraph 2 is not paid by the date specified by the Hotel in accordance with the provisions of the same Paragraph, the accommodation contract shall become invalid.However, this is limited to cases where the Hotel has notified the Guest to that effect when specifying the due date for payment of the deposit.
- Special contract requiring no payment of application fee

- Article 4 1.
- Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded.
- 2.
- If the Hotel does not request the payment of the application fee as stipulated in Paragraph 2 of the preceding Article and does not specify the due date for the payment of the application fee at the time of accepting the application for the Accommodation Contract, it will be treated as having accepted the special contract as stipulated in the preceding Paragraph. increase.
- Request for cooperation in infection prevention measures at facilities

- Article 4-2
- The Hotel may request cooperation from Guests seeking accommodation pursuant to the provisions of Article 23-138, Paragraph 4 of the Inns and Hotels Act (Act No. 2 of 1).
- Refusal to conclude an accommodation contract

- Article 5:
- The Hotel may refuse to enter into an Accommodation Contract in the following cases. However, this does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Inns and Hotels Act.
- When the application for accommodation does not comply with these terms and conditions.
- When there are no rooms available due to full occupancy.
- When it is deemed that there is a risk that the person seeking accommodation may engage in acts that violate the provisions of laws and regulations, public order, or good morals regarding accommodation.
- When the person seeking accommodation is deemed to fall under any of the following items (a) to (c):
- An organized crime group as defined in Article 3, Paragraph 77 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 2 of 2) (hereinafter referred to as an "organized crime group"), an organized crime group member as defined in Article 2, Paragraph 6 of the same Act (hereinafter referred to as an "organized crime group member"), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
- When a gang or a gang member is a corporation or other organization that controls business activities
- A corporation whose officers are classified as gangsters
- When a person intending to stay overnight engages in behavior that causes significant inconvenience to other guests.
- When the person seeking accommodation is a patient of a specific infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Inns and Hotels Act (hereinafter referred to as "patients of a specific infectious disease").
- When violent demands are made regarding accommodation or an unreasonable burden is requested (excluding cases where the person seeking accommodation requests the removal of social barriers pursuant to Article 25, Paragraph 65 or Article 7, Paragraph 2 of the Act on Promotion of Elimination of Disability Discrimination (Act No. 8 of 2; hereinafter referred to as the "Disability Discrimination Act").
- When the Guest seeking accommodation repeatedly makes requests to the Hotel that are deemed to be excessively burdensome and may significantly impede the provision of accommodation services to other Guests as specified in Article 5-6 of the Regulations for Enforcement of the Inns and Hotels Act.
- When accommodation is not possible due to natural disasters, facility malfunctions, or other unavoidable reasons.
- Explanation of refusal to conclude an accommodation contract

- Article 6 1.
- The Guest may cancel the Accommodation Contract by notifying the Hotel.
- 2.
- In the event that the Guest cancels the Accommodation Contract in whole or in part due to reasons attributable to the Guest (except in the case where the Hotel has specified a due date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2 and the Guest cancels the Accommodation Contract prior to payment), the Hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the Hotel has entered into a special contract as set forth in Article 4, Paragraph 1, this shall apply only if the Hotel has notified the Guest of the obligation to pay a penalty in the event that the Guest cancels the Accommodation Contract, in accordance with the special contract.
- 3.
- If the Guest does not arrive by 8:2 p.m. on the day of the stay without contacting the Hotel (or by two hours after the expected arrival time if the Guest has specified such time in advance), the Hotel may consider the Accommodation Contract to have been cancelled by the Guest.
- Hotel's right to cancel contract

- Article 7 1.
- The Hotel may cancel the Accommodation Contract in the following cases. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Inns and Hotels Act.
- When the Guest is deemed to be at risk of committing an act that violates the provisions of laws and regulations, public order, or good morals regarding accommodation, or when it is recognized that the Guest has committed the same act.
- When the guest is deemed to fall under any of the following (a) to (c).
- Organized crime groups, organized crime group members, organized crime group associate members, organized crime groups, and other anti-social forces
- When a gang or a gang member is a corporation or other organization that controls business activities
- A corporation whose officers are classified as gangsters
- When a guest makes a statement or behavior that causes significant inconvenience to other guests.
- When the guest is a patient of a specific infectious disease.
- When violent demands are made regarding the accommodation or an unreasonable burden is requested (excluding cases where the guest requests the removal of social barriers pursuant to Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities).
- When the Guest has repeatedly made requests to the Hotel that are deemed to be excessively burdensome and may significantly impede the provision of accommodation services to other Guests as specified in Article 5-6 of the Regulations for Enforcement of the Inns and Hotels Act.
- When it is not possible to stay overnight due to reasons such as natural disasters caused by force majeure.
- When the Guest fails to comply with the prohibited actions set forth in the Usage Regulations stipulated by the Hotel (limited to those necessary for fire prevention), such as smoking in bed, tampering with fire-fighting equipment, etc.
- 2.
- When the hotel has canceled the accommodation contract in accordance with the provisions of the preceding paragraph, the guest will not be charged for the accommodation services, etc. that have not yet been provided.
- Explanation of accommodation contract cancellation

- Article 7-2
- In the event that the Hotel cancels the Accommodation Contract in accordance with the preceding Article, the Guest may request the Hotel to explain the reason.
- Registration of accommodation

- Article 8 1.
- The Guest shall register the following particulars at the front desk of the Hotel on the day of accommodation.
- Name, address and contact details of the guest
- For foreigners who do not have an address in Japan, nationality and passport number
- Other matters deemed necessary by the Hotel
- 2.
- If the Guest intends to pay the charges set forth in Article 12 using a method that can be substituted for currency, such as a traveler's check, accommodation voucher, or credit card, the Guest must present these in advance at the time of registration as set forth in the preceding paragraph.
- Room usage time

- Article 9 1.
- Guests may occupy the hotel rooms from 3:11 PM to XNUMX:XNUMX AM the following morning. However, in the case of consecutive stays, guests may occupy the rooms all day except on the days of arrival and departure.
- 2.
- Notwithstanding the provisions of the preceding paragraph, the Hotel may permit guests to occupy their rooms outside of the hours specified in the same paragraph. In such cases, the following additional charges will be charged.
- Up to 3 hours over, 3/1 of the room rate
- Up to 6 hours over, 2/1 of the room rate
- Overtime of 6 hours or more: full room rate

- Article 10:
- Guests are required to observe the Hotel Usage Regulations established by the Hotel and posted within the premises of the Hotel.

- The opening hours of the main facilities of the Hotel are as follows. Detailed opening hours of other facilities will be announced on notices posted in various locations, in the service directories in the guest rooms, etc.

- payment of fees

- Article 12 1.
- The details of the accommodation charges, etc. to be paid by the Guest are as listed in Attached Table XNUMX.
- 2.
- The accommodation charges, etc. as stipulated in the preceding paragraph shall be paid at the front desk at the time of the Guest's departure or upon request by the Hotel in Japanese currency or by any other means acceptable to the Hotel, such as traveller's cheques, accommodation coupons, or credit card.
- 3.
- Accommodation charges shall be charged even if the guest voluntarily does not stay after the hotel has provided a guest room to the guest and it has become available for use.
- Liability of the Hotel

- Article 13 1.
- The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements, unless such damages have been caused by reasons beyond the Hotel's control.
- 2.
- Our hotel is covered by hotel liability insurance to cover the unlikely event of a fire or other incident.
- Handling when contracted rooms cannot be provided

- Article 14 1.
- When the Hotel is unable to provide a contracted room to a Guest, it will arrange accommodation of the same standards elsewhere for the Guest, with the Guest's consent, wherever possible.
- 2.
- If the Hotel is unable to arrange other accommodations, notwithstanding the provisions of the preceding paragraph, the Hotel shall pay the Guest a compensation fee equivalent to the penalty charges, which shall be applied to the amount of damages. However, if the Hotel is unable to provide a room due to reasons beyond the Hotel's control, the Hotel shall not pay the compensation fee.
- Handling of deposited items, etc.

- Article 15 1.
- In the event that loss, breakage or other damage occurs to goods, cash or valuables deposited by the guest at the front desk, the hotel shall compensate for such damage, except in cases where such loss or breakage is due to acts of God. However, in the case of cash and valuables, if the hotel requests the guest to clearly state their type and value and the guest fails to do so, the hotel shall compensate for such damage up to a maximum of 30 yen.
- 2.
- The Hotel shall compensate for damages incurred when loss, breakage or other damage occurs due to the Hotel's willful misconduct or negligence with respect to goods, cash or valuables brought into the Hotel by a Guest but not deposited at the Front Desk. However, for items for which the Guest has not previously notified the Hotel of the type and value, the Hotel shall compensate for such damages up to a maximum of 30 yen, except in cases where the damage is due to the Hotel's willful misconduct or gross negligence.
- Storage of guest's baggage or personal belongings

- Article 16 1.
- If the guest's baggage arrives at the hotel prior to their stay, the hotel will take responsibility for keeping it only when the hotel agrees prior to arrival, and will hand it over to the guest when he or she checks in at the front desk.
- 2.
- If a guest's baggage or belongings are found left behind at the hotel after check-out and the owner is identified, the hotel will contact the owner and ask for instructions. However, if the owner does not give instructions or the owner is not identified, the hotel will store the item for seven days, including the day it was found, after which it will be turned over to the nearest police station.
- 3.
- In the case of the preceding two paragraphs, the hotel's liability for the custody of the guest's baggage or belongings shall be in accordance with the provisions of paragraph 2 of the preceding article in the case of paragraph 1, and The provisions of paragraph 1 shall apply.
- parking liability

- Article 17:
- When a Guest uses the parking lot of the Hotel, regardless of whether or not the vehicle key is deposited, the Hotel only lends the space and does not assume responsibility for the management of the vehicle.However, if damage is caused intentionally or negligently on the part of the Hotel in managing the parking lot, the Hotel shall be responsible for compensation.
- Guest Responsibility
